This Privacy Policy explains how Tobo Capital Group LLC (“TOBO Capital Group”, “we”, “us”, “our”) collects, uses and shares information when you visit tobocapitalgroup.com or submit a funding request.
TOBO Capital Group is a commercial finance broker, not a direct lender. We arrange financing for businesses through third-party lender partners. This site is intended for business use, and the financing we arrange is for business and commercial purposes — not for personal, family or household purposes.
Information you give us
When you submit a request through this site, we collect the information you provide, which may include:
- Your name and company name
- Phone number and email address
- State of operation, and MC or DOT number if you provide one
- Details about the financing you are seeking — product type, asset type and requested amount
- Any message you choose to include
We do not ask for Social Security numbers, bank login credentials or payment card details through this website. If a lender requires sensitive information as part of underwriting, that lender collects it directly through its own process.
Information collected automatically
When you visit the site, we and our analytics provider collect limited technical information, including your IP address, browser type and user agent, device and operating system, the pages you view, the time of your visit and the page or source that referred you.
We collect this through server logs and through Google Analytics 4, described under “Cookies and analytics” below.
How we use your information
We use the information we collect to:
- Evaluate your request and match it with potential funding partners
- Contact you by phone or email about your request
- Send you text messages about your request, but only if you asked us to by checking the box on our form
- Prepare and submit applications to lenders on your behalf, with your authorization
- Operate, secure, troubleshoot and improve this website
- Meet our legal, regulatory and record-keeping obligations
- Detect and prevent fraud, spam and abuse of our forms
How we share your information
Because we are a broker, sharing your request with funding sources is the service you are asking us to perform. We share information with:
- Lender partners and funding sources who may be able to finance your request, so they can evaluate it and contact you
- Service providers who support our operations — website hosting, email delivery, analytics and advertising measurement, and similar tools — and who may use the information only to provide those services to us
- Legal and regulatory recipients, where required by law, regulation, subpoena, court order or other legal process, or to protect our rights, property or safety
- A successor, in connection with a merger, acquisition, financing or sale of assets
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not provide your information to unrelated companies for their own marketing.
Partner application portals
For some financing types, after you submit a request we redirect you to a lender partner’s online application portal, and we pass along the contact details you gave us — your name, email address and phone number — so that you do not have to type them again.
Once you are on a partner’s portal, that partner’s own privacy policy and terms govern the information you provide there. We do not control those sites.
Communications and consent
When you submit a request, you agree that TOBO Capital Group and its funding partners may contact you about that request by phone and email. Text messages are separate: we send them only if you asked for them, either by checking the box on our form or by telling us so on a call, and consent to texts is not required to submit a request. You can stop them at any time by replying STOP, and you can reply HELP to any message for help. Message frequency may vary. Message and data rates may apply. Calls are placed by a person: we do not use automated dialing systems, prerecorded or artificial voices, or bulk text campaigns for requests submitted through this site. Text messages are written and sent by a member of our team. The only messages that go out without a person writing them are the email confirming that your request arrived and the standard HELP and STOP replies that mobile carriers require us to send.
You can tell us to stop contacting you at any time — reply STOP to a text message, say so on a call, or email us — and we will honor that request. You can opt out of marketing email using the unsubscribe link in any marketing message. Opting out of marketing does not stop messages that are strictly about a request you submitted.
We will not sell or share your mobile information with third parties for promotional or marketing purposes. Your text-messaging opt-in and consent are never shared with any third party, including our funding partners. When you ask us to place your request with a funding partner, we pass your application details to that partner so they can respond to it. Funding partners contact you by phone or email only. No funding partner ever sends you a text message, and no funding partner receives your text-messaging consent.
Cookies and analytics
This site uses cookies to understand how it is used and to measure our advertising. We set two Google Analytics cookies — _ga, which distinguishes visitors, and _ga_Q4E05VM7B2, which tracks the session; one Google Ads cookie, _gcl_au, which lets us see which ad a visitor arrived from; and one cookie of our own, tobo_landing, which records the page you first landed on so we can pass that context along with your request.
These cookies are set when you arrive on the site. You can refuse or delete them in your browser at any time, as described below.
We use Google Analytics 4 and Google Ads, services provided by Google LLC, which set the cookies described above and collect technical information to produce aggregate reports about site traffic and to measure which ads lead to funding requests. You can prevent Google Analytics from collecting your data by installing Google’s official browser opt-out add-on, available at tools.google.com/dlpage/gaoptout, and you can control personalized advertising at myadcenter.google.com.
Google is a third party that may collect information about your activity on this site over time. We use these tools to measure our own advertising, and we do not sell your personal information.
You can also set your browser to refuse or delete cookies. Some parts of the site may not work as intended if you do.
Do Not Track
Some browsers send a “Do Not Track” signal. There is no common industry standard for how such signals should be interpreted, and this site does not currently respond to them. We describe above how you can limit analytics collection and cookies.
Your choices and rights
Several US states — including California, Colorado, Connecticut, Utah, Virginia and others — give residents rights over their personal information, such as the right to access, correct or delete it, and to opt out of certain uses. Whether a particular law applies depends on the law and on the size and activities of the business.
Regardless of whether a given law requires it, you may ask us to access, correct or delete the information you submitted through this site, or ask us to stop contacting you. Email info@tobocapitalgroup.com or call (630) 686-6296. We may need to verify your identity before acting on a request, and we may need to keep certain records where the law requires it.
We will not deny you service, charge you a different price or provide a different level of service because you exercised these rights.
How long we keep information
We keep request information for as long as needed to provide our services, to maintain business and transaction records, and to meet legal, tax and regulatory requirements. When we no longer need it, we delete it or keep it in aggregate form that does not identify you.
Security
We use reasonable administrative and technical safeguards to protect the information we hold, including encrypted transmission of form submissions. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Children
This site is intended for business use by adults and is not directed to children. We do not knowingly collect information from anyone under 18.
Changes to this policy
We may update this policy from time to time. The “last updated” date above reflects the most recent version. Material changes will be posted on this page.
